Terms and Conditions 

"BOURNE TO KAYAK"
Bourne To Kayak and First Aqua, are both trading names of First Aqua. 


"THE BOOKING"
Any activity that is run by Bourne To Kayak and to which these Booking Terms and Conditions apply.


"BOURNE TO KAYAK STAFF"
Any person who is authorised by Bourne To Kayak to fulfil The Booking.


"THE PARTICIPANT"
Any person who is authorised to take part in The Booking.


"THE CLIENT"
Any person or company who has made The Booking.


GENERAL TERMS

  • All customers must be able to swim at least 50 metres, and not be under the influence of any drugs or alcohol.

  • All customers must provide us with some form of identity.

  • Anyone under 16, must be accompanied by an adult (One adult per child under 16).

  • Minimum age is 8 yrs, subject to adult's experience.

  • Sharing of craft is not acceptable under any circumstances.

PREREQUISITES & RESTRICTIONS

The Client is responsible for ensuring they and The Participant meet the required standards to attend the Event. If The Client or Participant fail to meet the required standards they will not be allowed to attend the Event and no refund will be given.


INSURANCE

The Client and The Participant are advised to insure themselves against cancellation, personal injury and loss or damage to belongings and equipment. All of The Bookings are dependent on the weather or environmental conditions and will only run if it is safe to do so.

PROPERTY

The Participants are responsible for equipment loaned to them for the duration of their Booking and will be liable for loss or damage to the equipment unless such loss or damage is caused through fair “wear and tear”. Bourne To Kayak cannot be held responsible for any loss, damage or theft of The Participants’ belongings.

EQUIPMENT HIRE

The Participants are responsible for equipment hired to them for the duration of the hire and will be liable for loss or damage to the equipment unless such loss or damage is caused through fair “wear and tear”. The Participant will be charged at the current market price for any equipment that is not returned in the original state it was hired at.

MEDICAL CONDITIONS, ALLERGIES OR DISABILITIES

The Participant is responsible for ensuring they turn up fit and well to take part in their Booking, If in any doubt The Participant should contact Bourne To Kayak in advance of their Booking. If however at any point during The Booking, a Bourne To Kayak Staff member deems The Participant's health makes it unsafe for them to take part, may cancel or refuse their participation in the booking. No refunds will be given. All cancellations are subject to these Terms and Conditions.

Bourne To Kayak cannot accept any liability for any loss or injury caused by medical conditions that were not disclosed to Bourne To Kayak at the time of booking, or on the medical form. Disclosure of a medical condition will not necessarily prevent The Participant from attending their booking.

Where The Participant has an underlying medical condition, professional guidance should be sought as to confirm the suitability of the activity. Bourne To Kayak are unable to offer advice as we are not medical professionals.

SAFETY AND INSTRUCTION

Safety is of the utmost importance; therefore The Participant must act on any requests that are made by Bourne To Kayak Staff in the interests of health and safety.


The Bourne To Kayak Staff will terminate The Booking immediately for any Participant who refuses to act on their instructions.


For all water sports , The Participant must be confident in, and around water. The Participant must also be able to swim at least 50 meters.

Bourne To Kayak will not be responsible for any loss or injury caused to The Participant during The Booking if that loss or injury is caused by The Participant's own negligence.

ZERO TOLERANCE POLICY

All Clients and Participants are expected to communicate respectfully at all times. Disagreements or concerns should be expressed in a constructive and courteous manner. Any Client or Participant found using abusive language or actions towards The Bourne To Kayak Staff will face appropriate consequences, which may include the following: 
   •    Verbal or written warning.
   •    Temporary suspension from Bourne To Kayak
   •    Permanent explusion or terminaton from Bourne To Kayak
   •    Legal action if the abuse constitutes harrassment or violates any laws. 

 

Cancellation Policy 

CANCELLATIONS BY THE CLIENT

If The Client cancels their Booking within 30 days prior to the first day of The Booking, The Booking fees will be forfeit to Bourne To Kayak. If The Client cancels their Booking outside of 30 days prior to the first day of The Booking then 50% of The Booking fees will be forfeit to Bourne To Kayak.

CANCELLATIONS BY BOURNE TO KAYAK

Bourne To Kayak reserves the right to cancel or alter The Booking. If The Booking is cancelled (through no fault of The Client) an alternative date will be offered to The Client or a full refund will be given. If The Booking cannot be pursued due to health and safety or environmental conditions on the day and no alternative can be found, no refund will be given. No liability for consequential loss is accepted by Bourne To Kayak.

DISPUTES OR COMPLAINTS

If you are dissatisfied with the service and/or
facilities provided by us you shall, in the first instance, verbally explain
the cause of your dissatisfaction to a Bourne To Kayak Staff member. He/she will endeavour to solve the dispute. 

Should their solution be unacceptable to you the matter should be discussed with the Manager as soon as reasonably practical,
either in person or via email. Your conversation will always be confidential.
